Please read these terms and conditions (“App Terms”) carefully before downloading, installing, or using The Reliance Valves Multisafe App. These App Terms are a legal agreement between you and Reliance Worldwide Corporation (UK) Limited (company number 01442922) of Horton Road, West Drayton, Middlesex, UB7 8JL.
By downloading, installing, or using the App, you agree to these App Terms. If you do not agree to these App terms you must discontinue downloading, installing, or using the App.
Depending on the version of the App that you have downloaded, these App Terms incorporate the App Store Usage Rules or the Google Play Terms of Service (“Platform Terms”) which are incorporated into these App Terms. You acknowledge and agree that these App Terms are entered into between us and you and not with Apple or Google (“Platform Provider”) and the Platform Provider is not responsible for the App.
Grant and Scope of Use
We licence you to download, install and use the App subject to and in accordance with these App Terms.
You may download, install, and use the App for your personal use only.
To access and use the App, your device must meet the minimum specifications as detailed on the App or the Platform Terms from time to time or otherwise as notified by us to you.
You are responsible for making all arrangements necessary for your use of the App, including the provision of local network and internet access.
You are solely responsible for maintaining the confidentiality and security of your account with us, including any usernames and passwords (“Login Details”). We will not be liable for any unauthorised use of Login Details.
Your Use of the App
You must not use the App to do any of the following things:
Make alterations or modifications to any part of the App, or disassemble, de-compile, reverse engineer or otherwise attempt to derive any source code of the App
Make the App available over a network where it could be used by multiple devices at the same time.
Remove, alter and/or obscure any trademarks, copyright and/or notices of proprietary rights and restrictions on or in the App.
Use the App for any activity that is unlawful, or which encourages any unlawful activity; and
Use the App in a way that could damage, disable, overburden, impair or compromise our systems or security.
We cannot guarantee that the App be continuously available online free of any faults, interruptions and/or errors and you acknowledge and from time to time there may be disruptions to the provision of the App to enable us and/or our licensors to carry out necessary maintenance work.
You are responsible for your own conduct whilst using the App and for any content that is stored within or processed via the App and for any resulting consequences. You must not transmit, upload, post to or make available via the App any content or material that:
- Is (or might be) defamatory, offensive, obscene, illegal, or discriminatory.
- Infringes our or anyone else’s intellectual property rights (for example, by using or uploading someone else’s content).
- Transmits any viruses, worms, defects, Trojan horses, or other items of a destructive or harmful manner.
External services
All copyright and other intellectual property rights in the App including any trademarks, object code or source code are owned by us and/or our licensors and the rights in the App are licensed to you and not sold. You have no intellectual property rights in, or to, the App other than the right to use it in accordance with these App Terms.
If you become aware of any action or claim by a third party that the App infringes the intellectual property rights or other rights of a third party ("Intellectual Property Claim"), you shall:
Promptly notify us in writing of the action or claim.
Make no admissions or settlements without our prior written consent.
Co-operate fully with us; and
At our request give us or our licensors, complete control over the litigation and settlement of any action or claim and provide all information and assistance that we and/or our licensors might reasonably require.
If any Intellectual Property Claim is made or, in our reasonable opinion is likely to be made, against you, we may at our sole option and expense terminate these App Terms immediately by notice in writing to you.
For the avoidance of doubt, we will have no obligation regarding any Intellectual Property Claim based on use of the App in breach of these App Terms and/or where an Intellectual Property Claim relates to content inputted into the App by you.
Updates to the APP
We may update the App from time to time for reasons that include fixing bugs or enhancing functionality. We might also change or remove functionality but if we do that, we will ensure that the App still meets the description of it that was provided to you at the time you downloaded the App.
Updates will either download automatically or you may need to trigger them yourself, depending on your device, its settings, and the app store.
We strongly suggest that you download all updates as soon as they become available. Depending on the nature of the update, the App may not work properly (or at all), or you may be exposed to security vulnerabilities, if you do not keep the App updated to the latest version that we make available.
Changes to these App Terms
We may need to revise these App Terms from time to time to reflect changes in the App’s functionality, to deal with a security threat or if there is a change in the law or guidance.
You will be asked to agree to any material changes by an in-app notification, usually when you download an update. If you do not accept the changes, you will not be able to use the App.
Our responsibility to you
If we breach these App Terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time these App Terms were accepted by you, either it was clear that such loss or damage would occur, or you and we both knew that it might reasonably occur, because of something we did (or failed to do).
We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
Our total liability, whether in contract, tort (including negligence), breach of statutory duty or otherwise under or in connection with these App Terms shall in no circumstances exceed £100.
Nothing in these App Terms shall exclude or limit our liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability which may not be excluded or limited by law.
Termination
We may immediately and at any time change, terminate, suspend, remove, or disable your access or right to use the App in all cases without any liability, if you commit a breach of these App Terms.
The consequences of these App Terms terminating are as follows:
You are no longer allowed to use the App and we may limit your access to it.
You must immediately delete or remove the App from every device in your and your personnel’s possession; and
We may delete or suspend access to any accounts that you hold with us.
Collection of Data
You agree that in entering into these App Terms, we may collect technical information regarding the device you use the App on and/or use data that is captured by, stored within or otherwise processed by the App in an anonymised format, in order to analyse data for insight, provide insight and analytics to you, improve our products and services and/or as otherwise notified by us to you from time to time.

General
We may transfer our rights under these App Terms to another business without your consent, but we will notify you of the transfer and make sure that you are not adversely affected as a result.
You may not transfer, assign, charge or otherwise dispose of these App Terms, or any of your rights or obligations arising under them, without our prior written consent.
If any provision or part-provision of these App Terms is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.
Nothing in these App Terms is intended to or shall be deemed to establish any partnership or joint venture between the parties.
No one other than us or you have any right to enforce any term of the App Terms.
We shall not be in breach of these App Terms nor liable for delay in performing, or failure to perform, any of our obligations under these App Terms if such delay or failure result from events, circumstances or causes beyond our reasonable control.
LAW AND JURISDICTION
These App Terms, its subject matter, or its formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law and submitted to the exclusive jurisdiction of the English courts.
